Eminent Domain - Let's Seize a Supreme Court Justice's House!
cn | 24 January, 2006 16:06So a few months ago the US Supreme Court ruled that the government - on the local or state level - has the power and the right to seize privately owned property for "public benefit" - which essentially enabled the government to take your property if someone decided it could be used for a more economically beneficial purpose.
Sooooooo.....
So Logan Clements decided to see if he could actually put the whole thing to use (from news.bbc.com):
Activists angered by a US Supreme Court ruling that homes can be demolished for public developments are trying to seize the home of one of the judges involved.
About 60 people rallied in the small New Hampshire town of Weare on Sunday, where Justice David Souter has a house.
...
They want a compulsory purchase order on the 200-year-old farmhouse, and say they will build a hotel in its place.
...
Judge Souter was in a 5-4 majority on the court panel that ruled last June that the city of New London in Connecticut could seize homes to make way for a hotel, convention centre, office space and flats.
Clement, the man behind the drive to acquire Justice Souter's farmhouse, claims to have already gathered enough signatures to put the issue on the next ballot in Weare (pop. 8,500). Go Democracy!
